Terms of Service

These terms govern your use of Phone Keepsakes. We've written them in plain language so you know exactly what to expect from us — and what we ask of you.

Acceptance of Terms

By creating an account or using Phone Keepsakes, you agree to these Terms of Service. If you don't agree, please don't use our service. We may update these terms from time to time — if we make significant changes, we'll notify you by email or through the service before they take effect.

What Phone Keepsakes Does

Phone Keepsakes provides dedicated phone numbers that collect voicemail messages for your special events — weddings, birthdays, memorials, celebrations, and more. Callers dial your number, hear a custom greeting, and leave a voice message. You can listen to, download, transcribe, and share those messages through your account. We also provide features like analytics, QR codes, caller insights (including caller phone numbers), and shared access depending on your package. When someone calls your number, their phone number is collected as part of the voicemail record and is visible to you as the event owner. Caller phone numbers are used only for delivering the service and are never sold or shared with third parties for marketing purposes.

Your Account

You must be at least 18 years old to create an account. You're responsible for keeping your login credentials secure and for all activity that happens under your account. If you suspect unauthorized access, please contact us immediately. We ask that you provide accurate information when signing up and keep it up to date.

Payments & Billing

Phone Keepsakes offers paid packages on a per-event basis, billed through Stripe. When you purchase a package, you authorize us to charge your payment method for the selected package. Prices are displayed in your local currency and include any applicable taxes. For details on refunds, please see our Refund Policy.

Your Content & Ownership

You own your voicemail recordings and any content collected through your Phone Keepsakes number. We do not claim any ownership over your messages. By using the service, you grant us a limited license to store, process, and deliver your content solely for the purpose of providing the service to you. You can download or delete your recordings at any time. When you delete content or close your account, we remove it from our systems.

Acceptable Use

Phone Keepsakes is designed for collecting heartfelt voice messages from the people you care about. You agree not to use the service for:

  • Any illegal activity or to facilitate unlawful conduct
  • Harassment, threats, or abusive communication
  • Spam, robocalls, or unsolicited commercial messaging
  • Recording calls without the caller's knowledge where required by law
  • Reselling or redistributing the phone numbers we provide

We reserve the right to suspend or terminate accounts that violate these guidelines.

Third-Party Services

We use trusted third-party providers to deliver our service. Twilio powers our telephony infrastructure — phone numbers, call routing, and voicemail recording. Amazon Web Services (AWS) provides our cloud infrastructure, including data storage and backups — your voicemail recordings and account data are stored on AWS servers with encryption at rest and in transit. When you request a transcription, voicemail audio is sent to OpenAI's Whisper API over an encrypted connection for processing; OpenAI does not use API data for model training and retains inputs only briefly for abuse monitoring. When you use text-to-speech to generate a custom greeting, that text is sent to Google Cloud Text-to-Speech; Google does not retain it beyond processing. Stripe processes all payments securely. These providers have their own terms of service and privacy policies. We carefully select and monitor our providers, and we take commercially reasonable steps to ensure reliable service. However, because portions of our service depend on third-party infrastructure, there may be rare occasions where an issue with a provider affects your experience. If a third-party outage results in lost voicemails or service disruption, we'll work with you to find a fair resolution, which may include a partial or full refund for the affected period.

Service Availability

We work hard to keep Phone Keepsakes running smoothly, but we can't guarantee 100% uptime. Occasional maintenance, updates, or circumstances beyond our control may cause temporary interruptions. We use commercially reasonable efforts to ensure your voicemails are reliably captured, stored, and available to you. In the unlikely event that a service disruption causes voicemails to be lost or not recorded, we'll work with you to make it right — which may include a pro-rated credit or refund. Because voicemails capture irreplaceable moments, we strongly recommend downloading them regularly so you always have your own backup copy.

Limitation of Liability

We stand behind our service and take reasonable care to ensure it works reliably. That said, no technology platform can guarantee perfect operation at all times. To the fullest extent permitted by law, Phone Keepsakes and its owners, operators, employees, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages — such as emotional distress, lost opportunities, or costs arising from a missed recording. Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim. If we fail to deliver the core service you paid for — reliably capturing voicemails for your event — you may be entitled to a partial or full refund. Nothing in these terms limits our liability for fraud, gross negligence, or anything else that cannot be excluded under applicable law.

Termination & Data Retention

You can close your account at any time. After your package expires, your dedicated phone number will be released and will no longer accept new calls. Your voicemail recordings are stored securely for 1 year from your purchase date — you can listen to, download, and share them from your account at any time during that period, even after your phone number has been released. We recommend downloading your recordings before that window closes so you always have your own copy. We may also terminate or suspend your account if you violate these terms, with notice where reasonably possible.

Governing Law

These terms are governed by the laws of Canada and the Province of Ontario. Any disputes will be resolved in the courts of Ontario. If any part of these terms is found to be unenforceable, the remaining provisions will continue in full effect.
